Oscar was a quiet, gentle, unsophisticated man who had never been in trouble in his life. It just wasn't his way. Oscar had some serious physical conditions for a young man, which sometimes caused fleeting behavioral changes, until he took his medicine and it "kicked in". One night, Oscar didn't realize it at the time, but he went too long without his medicine. He felt about as lousy as he ever had in his life, and he'd been dealing with this chronic condition since childhood. For whatever the reason, his wife, Maria, was caught up in some real or imagined slight, and didn't pick up on the fact that Oscar was really sick. Instead, she got angrier and angrier at his utter silence (and apparent indifference), and rode him harder and harder. Oscar's head was pounding ... and the relentless onslaught of shouting by Maria really wasn't helping any. If she would only shut up. Oscar pretty much blacked out ... and woke up to his first night in jail ever, after an official detour to the hospital for treatment and medication. Oscar was horrified. What in the world had happened? Oscar never was able to remember. But Maria finally knew the whole truth. Oscar and Maria just wanted to start over and put this behind them, confident it would never happen again. Oscar retained me as his criminal domestic violence defense attorney for criminal court. I explained the criminal court process to Oscar and Maria. And the thought of testifying in criminal court was too much for Maria to bear, let alone Oscar. Oscar was more than happy to take some classes in his free time and go on probation, in return for the state dropping its case in the end. Oscar and Maria were both determined that something like this would never happen to them again. Oscar and Maria were delighted when I was able to close precisely that deal for Oscar. Oscar's and Maria's relationship only strengthened after this incident. So, later, I was able to expunge all traces of Oscar's arrest and criminal history.
