Carl and his girlfriend, Lily, got pregnant by accident. At least Carl thought it was an accident. They were really not right for one another. They had completely different values and ideas about child rearing. And they both had explosive tempers. But Lily had a real mean streak running through her. They had both done things they shouldn't have done during their relationship and Lily's pregnancy. But now they were fighting in South Florida over custody of their toddler daughter. Lily had momentarily snapped one day and really went after Carl. Did some damage too. She ended up getting arrested for her trouble. Carl won primary timesharing on a temporary basis. Although she wasn't very maternal, Lily didn't like that Carl had their daughter more than she did. Once Carl and Lily split up, Lily realized she had few ties to the community. She decided to moved in with relatives a few hundred miles north of Carl and their daughter, while she regrouped. She apparently realized she'd better do something to tip the scales in her favor in their custody battle, or Carl might keep primary timesharing - or more. Lily decided to go for a domestic violence restraining order against Carl in her new community several hundred miles to the north. Carl had a fit. Everyone who could speak up for him lived down in South Florida, just like their daughter and he did. He knew it would really be asking a lot for them to make that big trip over the weekend - and miss a day of work on Monday to the bargain. Carl hired me as his restraining order law attorney for his defense in domestic violence court. I advised Carl that that really wasn't necessary. I would get Lily's restraining order thrown out by that court. And that's how it played out. Lily didn't even get a chance to testify against Carl with her lies. And Carl didn't have to testify either. The judge up north dismissed Lily's order of protection for purely legal reasons. And Carl was one very happy dad. NOTE: Every case is different.
